Africa’s abundant renewable energy resources including solar, wind, hydro and geothermal steam present an opportunity for the continent to achieve universal electricity access from these resources.
The Firm supports local and international investors active in the renewable energy sector primarily operating in the solar, geothermal and hydropower segments. Our advice has been in the form of project due diligence stage, site acquisition, permitting and regulatory approvals including FiT Applications through to negotiation of Power Purchase Agreements.
The Firm’s lawyers have successfully supported bidders in RE projects as well as provided negotiation support to government entities in negotiations with private bidders for RE projects within Sub-Saharan Africa.
Recent assignments have included transaction advisory, legal, regulatory and procurement support in respect of a 2MW solar PV rooftop project as well as advising on the structuring, procurement and implementation of a proposed 20MW ground mounted solar PV plant and distribution system. The Firm has advised a generation licensee to operationalise and roll out solar PV installations under a 30MW licence within their licence area in Kenya.
The Firm has also provided legal and project transaction services to IPPs in respect of a 40MW ground mounted Solar PV project and provided negotiation support for a Power Purchase Agreement in respect of a 70MW Geothermal project. Finally, the Firm has advised a state corporation in the negotiation of a Power Purchase Agreement for 700MW hydropower project as part of a multipurpose dam project.
As part of our contribution to knowledge management in this sector, the Firm has previously authored the Kenyan Chapter of the Chambers Global Practice Guide on Alternative Energy & Power 2022 and Alternative Energy & Power 2023, which included an analysis of the legal and regulatory framework in over 20 jurisdictions globally.
